Terms of Service (End User License Agreement)
1. Acceptance of Terms
These Terms of Service ("Terms") are a legal agreement between you and SharpFace ("we", "us", "our") governing your use of the SharpFace mobile application (the "App"). By downloading, accessing, or using SharpFace, you agree to these Terms. If you do not agree, do not use the App.
2. Eligibility
You must be at least 16 years old to create an account or use SharpFace. By using the App, you represent that you meet this age requirement. SharpFace is not directed to children under 13, and we do not knowingly permit their use of the App.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep it up to date. You may sign in using Sign in with Apple, Google Sign-In, or use the App as a guest, subject to any limitations on guest features.
4. License to Use the App
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use SharpFace on devices you own or control, for your personal, non-commercial use. All rights not expressly granted to you are reserved by us. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works from the App, except as permitted by applicable law.
5. Subscriptions and Billing
SharpFace offers an optional auto-renewable subscription, SharpFace Premium, with the following plans:
- 1 Month — $3.99, billed monthly
- 3 Months — $7.99, billed every three months
Auto-renewal. Payment will be charged to your Apple Account at confirmation of purchase. Your subscription automatically renews for the same duration unless you cancel at least 24 hours before the end of the current period. Your Apple Account will be charged for renewal within 24 hours prior to the end of the current period, at the then-current price for the plan you selected.
Managing and canceling. You can manage or cancel your subscription at any time in your Apple Account settings: Settings > [your name] > Subscriptions on your device. Canceling turns off auto-renewal but does not refund any amount already charged; you retain access to Premium features until the end of the current billing period.
Restore Purchases. If you reinstall the App or switch devices, use the "Restore Purchases" option in the App to restore your active subscription and previously purchased Diamonds entitlements tied to your Apple Account.
Free trials and price changes. If we offer a free trial or introductory price, its terms will be disclosed at the point of purchase and are subject to Apple's standard subscription rules. We may change subscription prices for future billing periods; where required, we will notify you in advance.
All payments are processed by Apple through the App Store, in accordance with Apple's Media Services Terms and Conditions. Refunds are handled by Apple, not by us, in accordance with Apple's refund policies.
6. Diamonds (Virtual Currency)
SharpFace offers an optional in-app virtual currency called "Diamonds," purchasable only through Apple's in-app purchase system.
- Diamonds have no real-world monetary value and are not redeemable for cash or any other form of legal tender.
- Diamonds are non-refundable, except where required by applicable law or Apple's refund policies.
- Diamonds are non-transferable between accounts or users and cannot be sold, traded, gifted, or cashed out.
- Diamonds are a limited, revocable license to access certain features or content within the App and remain our property (or that of our licensors) at all times.
- We may adjust the availability, pricing, or uses of Diamonds at any time, and Diamonds may be forfeited if your account is terminated for violating these Terms.
7. Community, User-Generated Content, and Conduct
SharpFace includes community features (chat and a leaderboard) that let you post messages and photos visible to other users ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content within the App as necessary to operate the community features. You retain ownership of your User Content, and you are solely responsible for it.
Zero tolerance for objectionable content and abusive behavior. We have a zero-tolerance policy for objectionable content and abusive conduct on SharpFace, including but not limited to: harassment, hate speech, threats, bullying, sexually explicit or pornographic material, content that exploits or endangers minors, illegal activity, spam, and impersonation. Violations will result in content removal and may result in immediate suspension or termination of your account, at our discretion, without notice.
Report and Block. You can report objectionable content or abusive users, and block other users, directly within the App's community and chat features. We review and act on reports of objectionable content or abusive behavior within 24 hours.
Our moderation rights. We may remove any User Content and suspend or terminate any account, at any time and without prior notice, if we determine, in our sole discretion, that it violates these Terms or our zero-tolerance policy.
8. Health and Wellness Disclaimer
SharpFace provides general facial-exercise and wellness content for informational and fitness purposes only. SharpFace is not medical advice, is not a medical device, and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The App's exercises and program are not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before starting any new exercise program, especially if you have a pre-existing medical condition, are pregnant, or have concerns about your health. Stop any exercise immediately if you experience pain, discomfort, or any adverse reaction, and consult a medical professional. You use SharpFace's exercise content at your own risk.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY RESULTS FROM USING THE APP (INCLUDING FITNESS OR APPEARANCE RESULTS) WILL MEET YOUR EXPECTATIONS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SharpFace SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, GOODWILL, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. NOTHING IN THESE TERMS LIMITS ANY LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.
11. Termination
You may stop using SharpFace and delete your account at any time (Settings > Account > Delete Account). We may suspend or terminate your access to the App, without notice, if you violate these Terms, including our zero-tolerance content policy.
12. Governing Law
These Terms are governed by the laws of the country in which the App’s developer is established, without regard to its conflict-of-law principles, except to the extent applicable consumer-protection law in your country of residence requires otherwise.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means before the changes take effect. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
14. Apple App Store Terms
This section applies if you downloaded the App from the Apple App Store:
- These Terms are between you and SharpFace only, not with Apple, and Apple is not responsible for the App or its content.
- Apple has no obligation to furnish any maintenance or support services for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App; to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
- Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
- Apple is not responsible for the investigation, defense, settlement, and discharge of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You agree to comply with all applicable third-party terms when using the App.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.
15. Contact Us
SharpFace
